Linda Nestor et al v State of Washington. A driver failed to negotiate a curve on the I-5 southbound exit at Northgate Way in Seattle and landed on the Nestors’ vehicle on the highway on-ramp, killing Patrick Nestor and seriously injuring his wife and son. The Nestors sued the State of Washington for negligence, and the trial court granted the State’s motion for summary judgment and dismissed the claim. The Nestors appeal the dismissal. The State cross-appealed the admissibility of the Nestors’ evidence in opposition to summary judgment.
