State of Washington v David Lee Morris. Morris appeals his conviction for first degree murder with a deadly weapon enhancement for the death of his former girlfriend in a food court in front of their five year old son. He asserts that the court improperly excluded expert testimony regarding his PTSD and autism, failed to properly address his GR 37 challenge to the prosecutor’s exclusion of men from the jury, violated his constitutional rights by allowing jury selection via zoom, improperly denied a mistrial when a witness testified they had seen Morris in an orange jumpsuit, improperly gave a first aggressor instruction to the jury, and improperly imposed an exceptional sentence by making an impermissible finding of fact.
