State v Colindres. Colindres appeals his conviction of rape of a child in the first degree. He asserts that the trial court erred in not granting his motion for mistrial based on the prosecutor’s inflammatory and inappropriate questioning of the victim’s mother. He also claims that the prosecutor impermissibly commented on his prearrest silence, and that his attorney was ineffective when they failed to request a limiting instruction when a statement was admitted for impeachment purposes. Colindres further challenges imposition of the victim penalty assessment, some community custody provisions, and whether the trial court properly denied his motion to compel documents.
