- Jose Hernandez-Escobar was convicted by a jury of three counts of rape of a child in the first degree and one count of molestation of a child in the first degree. Hernandez-Escobar challenges the trial court’s determination that a potential juror was eligible to serve; claims double jeopardy because the trial court did not instruct the jury to rely on acts “separate and distinct” from the other counts for the molestation charge; and challenges the trial court’s refusal to poll the jurors on the factual basis of their verdicts.
