James v. State of Washington et ano
While investigating two adult family homes operated by Jessica Lakeru, the Department of Social and Health Services determined the homes were not in compliance with state regulations and suspended the homes’ licenses. Lakeru appealed the suspensions to the Office of Administrative Hearings, which determined that the suspension was arbitrary and capricious. Lakeru then sued the Department, alleging multiple torts. The Department moved for summary judgment asserting that the public duty doctrine barred Lakeru’s claims and issue preclusion did not apply to bar the Department’s defenses. The court granted the motion and dismissed the Lakeru’s claims. Lakeru appeals. COA # 860771. King County Superior Court # 22-2-1270-07.
